Terms of Service

These Terms of Service ("Terms") govern your access to and use of InstaDemo — the website, web application, and browser extension (the "Service") — operated by TechSpark Development LLC ("TechSpark", "we", "us", or "our"). These Terms also serve as our Terms and Conditions and Terms of Use. By creating an account or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date.

2. The Service

InstaDemo lets you generate narrated demo videos from websites and workflows you submit, including via the optional InstaDemo Autopilot browser extension. We may modify, add, or remove features at any time.

3. Plans, billing, and refunds

• Free and paid plans — the Service offers a free tier and paid plans (e.g., Pro) and optional add-ons, with the limits and features described on our pricing page.
• Billing — paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe and renew automatically until cancelled.
• Cancellation — you may cancel at any time; access continues until the end of the current billing period. Fees already paid are non-refundable except where required by law.
• Changes — we may change pricing prospectively with notice. Continued use after a price change constitutes acceptance.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right, including intellectual property and privacy rights.
• Submit or record websites, systems, or accounts you do not own or are not authorized to access and record.
• Attempt to bypass security, scrape, overload, reverse engineer, or disrupt the Service.
• Use the Service to create misleading, infringing, harmful, or unlawful content.

5. The Autopilot extension

The InstaDemo Autopilot extension records workflows you initiate. You represent that you are authorized to record the sites and accounts you capture, and that you have the right to use any credentials or sessions involved. You are solely responsible for the content you record and generate. Do not capture other people's accounts or confidential data without authorization.

6. Your content

You retain ownership of the URLs, recordings, scripts, and videos you create ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and provide the Service to you (including sending it to our processors such as OpenAI for narration). You are responsible for ensuring you have the rights to Your Content.

7. Intellectual property

The Service, including its software, design, and trademarks (including "InstaDemo"), is owned by TechSpark Development LLC and protected by law. Except for the rights expressly granted to you, we reserve all rights.

8. Third-party services

The Service integrates third-party services (e.g., OpenAI, Stripe, hosting providers). Your use of those features may be subject to their terms, and we are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements.

10. Limitation of liability

To the maximum extent permitted by law, TechSpark Development LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100.

11. Indemnification

You agree to indemnify and hold harmless TechSpark Development LLC from any claims, damages, and expenses arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the United States and the State in which TechSpark Development LLC is organized, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance.
